1. Acceptance of Terms
By accessing or using Whispa-AI's services, you agree to be bound by these Terms & Conditions. If you do not agree, please refrain from using our services.
2. Services Provided
Whispa-AI offers voice AI and automation solutions including but not limited to:
- Reception and appointment scheduling
- Message handling and call transfers
- FAQ and knowledge base delivery
- Inbound and outbound call automation
Services are tailored to individual and professional needs and may evolve over time.
3. Client Responsibilities
Clients agree to:
- Provide accurate information for service setup
- Use services in accordance with Australian laws, including the Spam Act and Do Not Call Register Act
- Not misuse voice agents for deceptive or unlawful purposes
4. Data Privacy & Security
Whispa-AI complies with the Australian Privacy Principles (APPs).
- Personal data is stored securely and used only for service delivery.
- Voice cloning is discouraged and only permitted with explicit written consent.
- Clients are informed of risks associated with synthetic voice technologies.
5. Intellectual Property
All content, workflows, and voice agent designs created by Whispa-AI remain the intellectual property of Whispa-AI unless otherwise agreed in writing.
6. Service Limitations
Whispa-AI does not guarantee uninterrupted service and is not liable for delays or failures caused by third-party platforms (e.g. Twilio, VAPI, ElevenLabs).
7. Payment Terms
- Fees are outlined in Quotation, Proposal, and Contractual Agreement.
- Payment is due upon invoice unless otherwise agreed.
- Late payments may incur a fee or suspension of services.
8. Termination
Either party may terminate services with 14 days' written notice. Whispa-AI reserves the right to suspend services for breach of these terms.
9. Dispute Resolution
Disputes will be resolved through good-faith negotiation. If unresolved, parties may seek mediation under Victorian law.
10. Changes to Terms
Whispa-AI may update these Terms & Conditions. Clients will be notified of material changes via email or website notice.
